A former mall security guard has filed a proposed class action claiming her former employer, Smith Guard, Inc., failed to pay her proper overtime wages under the Fair Labor Standards Act (FLSA). Filed in Georgia district court, the case specifically alleges the defendant maintained an unlawful policy of classifying its workers as independent contractors who were exempt from overtime pay. The suit argues that the plaintiff (and proposed class members) had a strictly defined employee-employer relationship with the defendant.
