NBTY, Inc. and United States Nutrition, Inc. have been hit with a proposed class action lawsuit alleging the companies mislead consumers by adding 37% “slack fill” to some of their Body Fortress and Pure Protein products. Plaintiffs claim that they were “surprised and disappointed” by the amount of empty space in the containers and say they wouldn’t have bought the products had they know about the slack fill. The suit outlines three classes – one for California consumers, one for New York consumers and a national class.
