Services, Supports and Solutions, Inc. and an individual are facing the claims of an employee who alleges that they misclassified him as an independent contractor.
Services, Supports and Solutions, Inc. and an individual owner are facing the claims of an employee who alleges that the defendants misclassified him as an independent contractor and failed to pay him overtime wages. In a proposed class action lawsuit, the plaintiff says he worked more than 40 hours per week for the defendants, but was paid at his straight-time rate instead of the time-and-a-half overtime rate required by the Fair Labor Standards Act. The suit argues that the defendants attempted to avoid paying overtime wages by misclassifying their employees as independent contractors who would not receive overtime.
