A proposed class action against Foodoni NY 23 Corp., which does business as E Taverna in Queens, New York, alleges workers were not paid proper overtime wages.
Three individuals have put their names on a proposed class action against Foodoni NY 23 Corp., which does business as Greek restaurant E Taverna in Queens, New York, as well as the company’s owner. The plaintiffs—two former chefs and a tipped waiter who ended their tenures working for the defendant at different times—claim they and similarly situated employees regularly worked upward of 40 hours per week without being paid proper time-and-a-half overtime, spread-of-hours pay (for shifts lasting longer than 10 hours in a day), and minimum wages.
Each plaintiff alleges they were never provided with meal breaks during work hours and were required to work several hours before the start of their scheduled shifts, as well as regularly stay after their scheduled end times, without any additional pay.
