The operating company of New York City pizza joint Pizza Pete’s and its three owners are facing a proposed collective action over alleged wage and hour violations of the Fair Labor Standards Act (FLSA). The plaintiff alleges he worked long days as a food preparer and tipped delivery worker for Pizza Pete’s LLC, but was forced to spend several hours—more than 20 percent—of each day performing non-tipped, non-delivery-related duties around the restaurant. According to the complaint, the plaintiff was hired as a delivery worker ostensibly so the defendants could disguise the true nature of his job in their payroll records, and is thus owed unpaid minimum, spread-of-hours, and time-and-a-half hourly overtime wages.
