PillPack LLC is facing a proposed class action lawsuit from a Washington resident who claims to have received unsolicited promotional calls from the online pharmacy.
The lawsuit alleges that PillPack used an automatic telephone dialing system to place two calls to the plaintiff’s cell phone without first obtaining his written consent to be contacted, an apparent violation of the Telephone Consumer Protection Act (TCPA). The man adds that he had no prior relationship with the company and that his phone number has been listed on the National Do Not Call registry since 2010.
According to the complaint, PillPack, an Amazon subsidiary, promotes its prescription refill services by placing automated calls to prospective customers. When taking the call, recipients are apparently met with a prerecorded prompt asking if they take prescription medication. If the consumer confirms that they do, the case continues, the call is transferred to a customer service representative.
The suit estimates that the amount of people who received similar unauthorized calls “likely number(s) in the hundreds or thousands.”
