From New York comes a proposed class action that alleges Palace Chicken and Grill and its owners committed numerous wage and hour violations ranging from unpaid minimum and overtime wages to the misappropriation of employees’ tips. Alleging Fair Labor Standards Act (FLSA) violations, the suit claims the defendants hired the plaintiff as a delivery worker, yet required him to spend a “significant amount of time” performing non-tipped work tasks, including cooking and cleaning. These non-tipped duties, the lawsuit asserts, would take up more than half of the plaintiff’s shift.
The plaintiff claims he worked from September 2015 through July 2016 at an hourly rate below the federal minimum. On top of that, the plaintiff says he only retained a small portion of the tips he received from deliveries—only $2 from each cash tip amount—with the rest going to one of the restaurant’s owners who allegedly kept a “substantial portion” of employees’ tips for himself. Lastly, the suit claims the defendants would continuously alter the time records of the plaintiff and proposed class members, as well as make the plaintiff pay for repairs to his delivery bicycle from his own wages.
