OneTouchPoint Data Breach Settlement Resolves Lawsuit Over 2022 Cyber Incident

OneTouchPoint Corp. (OTP) has agreed to a class action settlement to resolve a lawsuit that alleged the marketing and brand-experience company failed to protect the sensitive information of current and former employees and its clients’ patients and subscribers from an April 2022 data breach.

The OneTouchPoint class action settlement received preliminary approval from the court on July 16, 2026. The settlement covers all individuals in the United States and its territories whose private information was determined by OneTouchPoint’s investigation to have been impacted in the data incident in or around April 2022 (known as the monetary settlement class). The deal also covers all individuals in the U.S. and its territories who were sent notice by OTP of a potential impact to their private information in the data incident, but for whom the impact could not be confirmed (known as the injunctive relief settlement class). 

The court-approved OTP data breach settlement website can be found at OTPDataIncident.com. 

Class members whose data was determined to have been involved in the incident and who submit a timely, valid claim form can receive up to $5,000 for documented “extraordinary” losses incurred due to the OTP data breach. This benefit covers proven monetary losses and costs for attorneys’ and accountants’ fees, credit repair services and more.

The same group of class members can also file a claim form to receive up to $500 in reimbursement for documented “ordinary” losses stemming from the data breach. This benefit covers costs for bank fees, credit reports, credit monitoring, identity theft insurance and more. 

Monetary settlement class members can also submit a claim for reimbursement of up to four hours of lost time spent dealing with the data breach, at a rate of $25 per hour. 

In lieu of any other monetary benefits, monetary settlement class members can submit a claim form to receive a $75 cash payout, with no proof required. 

Monetary settlement class members can also elect on their claim form to receive two years of one-bureau credit monitoring, which includes fraud protection. 

Class members who were sent a data breach notice from OneTouchPoint but for whom involvement in the incident could not be confirmed cannot file a claim form for monetary reimbursement or credit monitoring. However, OneTouchPoint has agreed to ensure that their data is protected through its cybersecurity changes. 

To file a OneTouchPoint settlement claim form online, class members can head to this page and enter the claim number and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator. 

All OTP settlement claim forms must be filed online or by mail by November 16, 2026. 

The court will decide whether to grant final approval to the OneTouchPoint data breach settlement following a hearing on November 18, 2026. Settlement benefits will begin to be made available after the deal has received final approval and any appeals are resolved. 

The lawsuit against OneTouchPoint alleged that the company, which works with corporate clients in the healthcare, health insurance, manufacturing and supply, retail, and financial sectors, among others, failed to adequately protect the sensitive information of more than one million people from unauthorized access.
