Two individuals allege in a proposed class action that their former joint employers, Jax Inn Restaurant Corp. and Modern Hospitality Group Corp., owe unpaid wages.

Two individuals allege in a proposed class action that their former joint employers, Jax Inn Restaurant Corp. and Modern Hospitality Group Corp., as well as the companies’ owners, owe unpaid overtime wages and “misused tips.” The plaintiffs, who worked various roles during their tenures at the Jax Inn Diner in Jackson Heights, New York, allege they worked between 70 and 81 hours per week and at least 55 hours per week, respectively, without being paid the proper minimum hourly wage, time-and-a-half overtime, or spread-of-hours pay.
The lawsuit further claims the defendants “misused or retained tips or gratuities” rightfully owed to the plaintiffs and proposed class members, as well as failed to provide workers with proper wage statements and post mandatory notices in the workplace informing employees of their Fair Labor Standards Act and New York Labor Law rights.
