Nutrabolt Facing Slack-Fill Class Action Over Cellucor C4 Pre-Workout Powders
Last Updated on July 24, 2018
Lopez v. Woodbolt Distribution, LLC
Filed: July 9, 2018 ◆§ 2:18-cv-05963
According to a class action, Woodbolt Distribution, which does business as Nutrabolt, misleadingly packages and sells its Cellucor C4 Pre-Workout powders.
A proposed class action recently removed to federal court in California details allegations that defendant Woodbolt Distribution, LLC, which does business as Nutrabolt, misleadingly packages and sells its Cellucor C4 Pre-Workout powders.
While Nutrabolt sells its workout powder in purported 30- and 60-serving size containers, the lawsuit alleges the product’s opaque packaging conceals from consumers the true amount of product inside. According to the complaint, containers of the defendant’s pre-workout powder contain a significant amount of non-functional slack fill—empty space. The plaintiff outright alleges the defendant only half-fills containers of its pre-workout powder as a means to lower costs.
“If [the plaintiff] and other consumers had known the actual amount of pre-workout powder contained in the packaging,” the complaint argues, “they would not have purchased the C4 Pre-Workout or would have paid less for it.”
