Living Intentions Hit with Class Action Over White Chocolate Claims for Superfood Nut Blend

Living Intentions, LLC’s Superfood Nut Blend White Chocolate is at the center of a proposed class action that alleges the product misleadingly contains no white chocolate. The 26-page suit alleges consumers have been misled by the defendant’s labeling, marketing, and advertising into buying an inferior, misbranded product.

From the complaint: 

“The phrase ‘White Chocolate’ implicitly promises to consumers that the Product contains white chocolate when, in fact, it does not. [The plaintiff] was injured when they [sic] were denied the benefit of their [sic] bargain.”

More specifically, the case states that the flavor in real white chocolate is partially imparted by milkfat. The defendant’s product, the suit argues, does not have milkfat nor any of the other ingredients required by the FDA for a product to be labeled as white chocolate.
