A proposed class action claims Fernandez Brothers, Inc. violated federal law by failing to pay seasonal strawberry harvesters all wages owed for rest periods (and other non-productive work time) and failing to provide the individuals with second rest periods after they’d worked more than six hours (but less than seven and a half hours) in a day. The lawsuit alleges the defendant violated labor codes pertaining to the discharge of seasonal workers, as well as the Migrant and Seasonal Agricultural Workers Protection Act.
