Denville Line Painting, Inc. is on the receiving end of a proposed class action filed by a former employee who claims he was not paid prevailing wage and supplemental benefit rates for work he performed on publicly funded projects in New York and New Jersey. According to the suit, the defendant contracted with public entities to perform pavement work and noted in the contracts that workers would be paid according to prevailing wage and supplemental benefit rates, which the complaint says fell between $50 and $80 per hour. The plaintiff says he was paid below these rates for both his straight-time hours and his overtime hours, in violation of the defendant’s contracts and state law.
