A Georgia consumer has filed suit against Behr Process Corp., Behr Paint Corp., Masco Corp., The Home Depot, Inc., and Home Depot U.S.A., Inc. claiming the defendants manufactured, marketed, and sold a resurfacing product known as DeckOver that failed to live up to its claims of superiority and durability. The plaintiff says he relied on the defendants’ representations that DeckOver would “revitalize” outdoor surfaces and hired a professional to apply the allegedly “made-to-last” product to his deck, only to discover months later that the resurfacer had begun to bubble and crack.
“Thus,” the complaint argues, “rather than providing homeowners with a premium option for reducing maintenance work and improving the look and performance of their patios and decks, DeckOver performs worse than cheaper options and requires hours of scraping, scrubbing, and sanding to remove it (with some homeowners resorting to replacing their decks entirely).”
