Northern Children's Services is the defendant in a lawsuit that claims it failed to pay its employees proper overtime wages.
Northern Children’s Services is the defendant in a proposed class action that claims it “willfully engaged in a pattern, policy, and practice of unlawful conduct” by failing to pay its employees proper overtime wages. The plaintiff claims she and proposed class members regularly worked for more than 40 hours per week providing therapeutic support to children with emotional or behavioral problems. According to the complaint, Northern Children’s Services did not pay its employees the required time-and-a-half overtime wages entitled to them under the Fair Labor Standards Act (FLSA), even though their hours were accurately recorded on weekly time sheets. The suit claims the defendant “knew, or showed reckless disregard for the fact, that it failed to pay these individuals proper overtime compensation in violation of the FLSA.” It further asserts that Northern Children’s Services “realized additional earnings to its own benefit and the detriment of Plaintiff and the…class members.”
