A proposed class action has been filed out of Florida by 32 plaintiffs against their former employer, Swissport SA, LLC. The plaintiffs claim they worked for the defendant re-fueling airplanes at Miami International Airport, but were not paid overtime wages for hours worked in excess of 40 per week. According to the suit, the plaintiffs were often required to work before and after their scheduled shifts and during their 30-minute unpaid lunch breaks. These “off-the-clock” hours were unaccounted for by Swissport, the plaintiffs argue, and caused their wages to fall below the requirements set under the Fair Labor Standards Act.
