From Pennsylvania district court comes a proposed class action against JCS Military Support Services, Inc. and Magellan Health, Inc. claiming individuals working as Military Family Life Counselors (MFLCs) were not paid proper overtime wages. The defendants operate contractually for the U.S. Government providing behavioral counseling to active, reserve, and veteran military members and their families. The plaintiff, who currently works for the defendants, claims he and similarly situated MFLCs regularly work in excess of 40 hours per week but are not paid at the time-and-a-half hourly overtime rate for all hours worked over 40. On top of this, the lawsuit claims the defendants knowingly required proposed class members to work off the clock without compensation.
