EDLS, Inc., which does business as Romeoville, Illinois restaurant Tasty Waffle, and its owner are facing a former employee's proposed class and collective action.
EDLS, Inc., which does business as Romeoville, Illinois restaurant Tasty Waffle, and its owner are facing a former employee’s proposed class and collective action that seeks allegedly unpaid wages resulting from improper deductions. The plaintiff, who the case says has worked as a server for the defendants for the last three years, alleges she and others were purportedly paid $4.95 an hour, but that this hourly wage is, in truth, was much lower after the defendants took a tip credit to which they were not entitled.
Further, the plaintiff claims she and similarly situated individuals were required to work off the clock without pay. Specifically, the case claims servers were required to show up at least a half hour prior to the start of their shifts, as well as stay an additional half hour after the end of their shifts, without pay.
