November 23, 2022 - Hibbett, City Gear Point-of-Sale Receipt Class Action Settled for $6 Million

Although the proposed class action detailed on this page was moved to Orange County (Calif.) Superior Court back in July, a $6 million settlement in a similar case filed in Alabama in February has received preliminary approval, meaning the time has come for consumers to file claims for compensation.

To file a claim online, head to this page. While you do not need a notice ID to file a claim for compensation, those who received notice about the settlement directly are asked to input their notice ID before proceeding with the form. After inputting basic contact details and, if applicable, your Hibbett Rewards account number, select which store you made your qualifying purchases at, as well as the date and payment card issuer.

Eligible claims must be submitted online or postmarked by February 8, 2023. If you do nothing, you will receive no compensation from the settlement and lose your right to sue the defendants over the allegations covered in the litigation.

The settlement covers all persons in the United States who made a purchase at a Hibbett, City Gear or Sports Additions store between December 15, 2020 and February 23, 2022 using a credit or debit card and received a receipt that displayed more than the last five digits of their payment card. In addition to paying the $6 million settlement, Hibbett has also agreed to implement certain practices and a written company policy to ensure its stores comply with the Fair and Accurate Credit Transactions Act (FACTA).

A proposed class action alleges the operators of Hibbett Sports and City Gear athletic wear stores print too many digits of customers’ payment card numbers on point-of-sale receipts.

The 29-page lawsuit alleges defendants Hibbett, Inc. and Hibbett Retail, Inc. have violated the federal Fair and Accurate Credit Transactions Act (FACTA), which prohibits a merchant from printing more than the last five digits of a customer’s payment card number on receipts provided at the point of sale.

According to the suit, the defendants are well aware of, yet have refused to comply with, FACTA payment card truncation requirements, which the case notes have been in place since 2003. As a result, the lawsuit says, the companies have subjected customers at their more than 1,000 athletic wear stores to a heightened risk of identity theft.

The plaintiff is an Orange County, California resident who says he used his personal credit card to make a purchase at a Fullerton, California Hibbett Sports store in January 2022. Per the case, the plaintiff was provided with a receipt that disclosed the first six and last four digits of his credit card number. The man claims that he was required to take steps to safeguard his receipt as a result of the defendants’ unlawful disclosure of 10 digits of his credit card account number.

The lawsuit, which was initially filed in Orange County Superior Court on April 29, 2022 before being removed to California’s Central District Court on June 1, looks to represent anyone in the U.S. who, within the relevant timeframe, engaged in one or more transactions using a debit or credit card at one or more of Hibbett’s retail locations in the U.S. and was provided an electronically printed receipt that displayed the first six and last four digits of their payment card number.
