A proposed class action lawsuit has been filed in the wake of a May 2026 crisis at GKN Aerospace’s Garden Grove, California, facility during which a compromised chemical storage tank containing methyl methacrylate emitted toxic, dangerous fumes into the air.

The 23-page lawsuit against GKN Aerospace Transparency Systems, GKN Aerospace Services Ltd., and Melrose Industries PLC alleges that GKN Aerospace negligently stored, contained, handled, and monitored massive amounts of methyl methacrylate (MMA), a volatile and flammable liquid used to make acrylic plastics, in a “compromised” 34,000-gallon tank at its 12122 Western Avenue facility.
The suit claims that the storage tank was “in crisis” and, as a result, caused the hazardous substance within to overheat and emit toxic fumes into the surrounding area on May 21, 2026. According to the case, 50,000 residents near the facility were ordered to evacuate over concerns of toxic exposure.
The environmental lawsuit shares that MMA has been linked to acute health effects in humans, such as skin and eye irritation, coughing, wheezing, and chest tightness, and can readily penetrate protective gloves and clothing, meaning the chemical can harm individuals “without their knowledge.”
The U.S. Environmental Protection Agency warns that exposure to MMA can cause harm to the respiratory system and lead to neurological symptoms, cardiovascular disorders and colon or rectal cancers, among others, the case relays. Moreover, the lawsuit says that MMA has been known to cause similar harmful effects in animals, including liver damage, necrotization of the kidneys, lung damage, and more.
The class action lawsuit adds that California Governor Gavin Newsom declared a state of emergency on May 23, stating that the “magnitude and impact” of the crisis would likely require “the combined forces of a mutual aid region or regions to appropriately respond.”
The plaintiff, who lives within the evacuation zone, was displaced from his home just days after his child was born. Because of GKN’s negligent conduct and the subsequent crisis, the plaintiff claims to have lost enjoyment and use of his property and is concerned about the future health implications of exposure to MMA, the case says.
The class action lawsuit seeks compensatory damages and equitable relief in the form of a medical monitoring program and the establishment of a fund for the affected plaintiffs, who have been exposed to dangerous substances, fumes and/or byproducts that significantly increase the risk of “serious injury” to those in the evacuation zone.
Those in the evacuation zone must now cope with ongoing “fear, anxiety, annoyance, inconvenience, and distress arising from the threat of toxic exposure and catastrophic storage failure,” the lawsuit stresses.
The GKN Aerospace class action lawsuit looks to cover all individuals who occupied, rented, or owned property or other accommodation within the containment area, as defined by the Orange County Fire Authority on May 22, 2026.
According to media reports, the Federal Bureau of Investigation on June 10 executed a search warrant at the GKN Aerospace Transparency Systems facility to seize documents and records related to the storage, use, or disposal of MMA. The warrant also authorized the FBI to seize records related to cooling equipment or other equipment used to control the temperature of MMA.
