A proposed class action against defendants Frazee Construction Co Inc. and its owner alleges individuals working as laborers were stiffed out of proper time-and-a-half overtime wages. Citing violations of the Fair Labor Standards Act (FLSA), the case claims that if proposed class members worked more than 40 hours in a week, they were paid at their regular hourly rate, not the mandatory time-and-a-half rate, by the defendants with separate “contract labor” checks.
