Leleux v. The Covelli Family Limited Partnership et al
Filed: April 26, 2017 ◆§ 6:17-cv-00747-RBD-TBS
The operating companies of Panera Bread are the defendants in a proposed class action lawsuit filed by a former employee who claims she was not paid proper wages.
The operating companies of Panera Bread are the defendants in a proposed class action lawsuit filed by a former employee who claims the restaurant failed to pay her proper overtime wages. The plaintiff says she worked for the defendants as a catering coordinator and would often work between 50 and 55 hours per week. According to the lawsuit, the plaintiff received bonuses, delivery fees, and tips in addition to her hourly wage, but the defendant did not include this extra pay in its overtime wage calculations. Furthermore, the plaintiff claims she was often required to communicate with customers and other employees outside of her regularly scheduled shifts in order to discuss customer orders and answer questions, but was not paid for the time she spent performing these “off the clock” activities. Therefore, the suit argues that Panera violated the Fair Labor Standards Act in not properly compensating the plaintiff for all the overtime hours she worked.
