A man formerly employed as a 'helper' and truck driver by Waste Pro of Florida, Inc. has filed a proposed class action against the company over unpaid overtime wages.
A man formerly employed as a “helper” and truck driver by Waste Pro of Florida, Inc. has filed a proposed class action against the company and two individuals alleging he and other waste disposal workers were not paid mandatory time-and-a-half overtime wages. Citing alleged Fair Labor Standards Act (FLSA) violations, the lawsuit claims the plaintiff worked an average of 62 hours per week for the defendants but was never paid at the time-and-a-half hourly premium for all hours worked past 40 each workweek. What’s more, the plaintiff claims he and proposed class members, after complaining about the alleged lack of overtime pay, were told by the defendants that in their line of business workers were paid a day rate only and that “it is what it is, that’s how it works.”
