A former employee of Ideal Lumber & Hardware, Inc. has filed suit against the company and two individual owners for allegedly failing to pay him proper overtime wages.
A former employee of Ideal Lumber & Hardware, Inc. has filed suit against the company and two individual owners for allegedly failing to pay him proper overtime wages for the duration of his employment. The plaintiff – who was employed by the defendants as a warehouse worker and delivery driver – claims he regularly worked 54 hours per week, but was paid $8.88 for every hour worked, in violation of the overtime requirements set forth by the Fair Labor Standards Act. The complaint argues that the plaintiff and proposed collective members should have been compensated at a time-and-a-half rate for all hours worked in excess of 40 per week.
The suit is seeking to certify a collective of people who worked for the defendants any time during the past three years and who did not receive proper overtime and/or minimum wages.
