Lobsters In Mocean, Inc. (which does business as The Lazy Lobster of Longboat) and an individual are facing claims that they failed to pay employees proper wages.
Lobsters In Mocean, Inc. (which does business as The Lazy Lobster of Longboat) and an individual are facing allegations of a former employee who claims they failed to pay him proper minimum and overtime wages. He says he worked as a food runner at the seafood restaurant and was illegally paid at a tip-credited rate. The suit argues that the defendants were not permitted to take a tip credit because they failed to inform the plaintiff of the tip credit and required him to spend a significant amount of time performing non-tipped duties. The plaintiff further claims that he worked more than 25 hours of overtime per week and was not paid one-and-a-half times his regular rate for those hours. According to the complaint, the defendants “went through great efforts to circumvent the FLSA, manipulating time records and requiring employees to work off the clock with no compensation.”
