Flagship Resort Development, LLC is on the receiving end of a proposed class action lawsuit that claims it misclassified its workers as independent contractors.
Flagship Resort Development, LLC (which does business as Fanta Sea Resorts) is on the receiving end of a proposed class action lawsuit that claims it misclassified workers as independent contractors instead of employees and denied them their rights under the Fair Labor Standards Act and state law. The plaintiff says he sold timeshares in Atlantic City for the defendant and would often work over 40 hours per week, but was not paid overtime wages for the weekly hours he worked above 40. He further claims that the defendant failed to withhold from his paychecks deductions that would normally be associated with paying employees, such as Social Security payments, federal/state taxes, and insurance. The suit is seeking unpaid overtime wages and other monetary damages for proposed class members.
