Messerli & Kramer, P.A. and Jefferson Capital Systems are on the receiving end of a lawsuit wherein a consumer alleges the defendants failed to disclose that interest was accruing on her closed Comenity Bank credit card account.

Law firm Messerli & Kramer, P.A. and collection agency Jefferson Capital Systems, LLC are on the receiving end of a proposed class action wherein a consumer alleges the defendants failed to disclose that interest was accruing on her closed Comenity Bank credit card account.
Filed in Wisconsin, the lawsuit takes issue with a January 2018 collection notice sent by Messerli & Kramer concerning the plaintiff’s Meijer-branded credit card debt. According to the case, the letter stated that the woman owed $1,192.11, whereas previous letters received in January and April 2017 regarding the same account indicated a lesser balance of $1,124.06. The suit alleges the defendants’ letter did not disclose that the debt amount was subject to change and failed to provide an itemized list of interest charges.
“When the amount of the debt varies day to day, the debt collector should avoid confusion by including explanatory language in the letter,” the complaint states.
