A former worker has filed a class action suit against D & D Landscape Design & Construction, Inc., J & D D'Amico Enterprises Corp. and their owners.
A former worker has filed a class action suit against D & D Landscape Design & Construction, Inc., J & D D’Amico Enterprises Corp. and their owners claiming he was not paid proper overtime wages under the Fair Labor Standards Act (FLSA). The suit alleges the plaintiff worked between 55 and 66 hours per week from July 2010 until his termination in 2014 and was paid a flat rate instead of the FLSA-mandated time-and-a-half overtime rate. Additionally, the suit says the plaintiff never received at least 30 uninterrupted minutes for a lunch break.
