Midland Credit Management, Inc. is facing allegations that it violated federal law by failing to clearly state the amount of a consumer’s alleged debt. The plaintiff claims she received a collection letter from the defendant that included her “current balance” and a settlement offer. However, the letter supposedly neglected to mention whether the balance included interest and other fees, or whether interest would continue to accrue on the account. As a result, the suit claims the least sophisticated consumer would be unable to accurately determine the amount of his or her alleged debt. The defendant’s letter is considered to be “misleading” under the Fair Debt Collection Practices Act because it is open to more than one interpretation, according to the complaint.
