A proposed hybrid collective action against North Star Gas Ltd. Co. and Peoplease LLC claims the companies, which work in the propane supply and distribution area, violated the Fair Labor Standards Act (FLSA) and California labor law by failing to pay current and former propane transporters proper overtime wages. Filed by a former non-exempt driver, the lawsuit alleges he and similar employees were compensated on a piece-rate basis for each route driven. As a result of the long period of time it takes to transport propane along a given route, the case says, workers often worked well over 40 hours per week without time-and-a-half overtime pay.
