A North Dakota man has filed a proposed class action lawsuit that claims defendant Thru Tubing Solutions, Inc. illegally misclassified employees.
A North Dakota man has filed a proposed class action lawsuit that claims defendant Thru Tubing Solutions, Inc. illegally misclassified him and similarly situated individuals working as operators as independent contractors. This alleged Fair Labor Standards Act violation, the lawsuit says, resulted in proposed class members not being paid rightful time-and-a-half overtime wages for all hours worked over 40 in a week. Instead of receiving overtime pay, proposed class members were allegedly only paid a salary in conjunction with a “series of non-discretionary bonuses,” the complaint says.
