EBS Security, Inc. is the defendant in a proposed class action alleging the company did not pay time-and-a-half overtime wages as required by the Fair Labor Standards Act (FLSA). The former security worker who filed the suit claims he was paid at a straight-time rate regardless of how many hours over 40 he worked per week. When the plaintiff confronted his supervisor about the absence of proper overtime pay, he was told his employer does not pay overtime at all and he thought his co-workers would have made that clear. Specifically, the lawsuit notes, the plaintiff’s supervisor said he is “tired of trying to please you people (security guards).”
