Class Action: Ametros Provides No Significant Discounts for Settlement Recipients

The case says that Ametros, which provides post-settlement medical administration services, claims on its website that members can save “on average 62% on provider visits and 28% on your prescriptions.” According to the plaintiff, however, Ametros has failed to pass on “any significant discounts” to customers, and has instead pocketed the savings “for its own revenues.”
The plaintiff, whose settlement account was managed by Ametros, claims that the discounts he did receive paled in comparison to the averages represented in the company’s marketing and advertising materials. In fact, the man argues that Ametros in each of the last three years exhausted his yearly allotment of workers’ comp settlement money months before the fund would replenish despite representing that its bargaining power and group discounts would save him money. In each instance, the plaintiff claims, he went months without money to pay for his medical claims.
“Plaintiff and others believed, trusted and relied on Ametros,” the complaint reads, “and, in justifiable reliance thereon, continued to incur costs for medical services believing that Ametros was obtaining promised discounts resulting in higher payments for those medical services.”
The lawsuit seeks to cover a proposed class of individuals who had a Medical Cost Projection Post-Settlement Administration Agreement with Ametros any time since August 30, 2013 and received services through the company’s CareGuard payment services product.
