A proposed class action lawsuit filed against Byte Federal over a November 2024 data breach has been resolved with a settlement that will provide credit monitoring and cash payments to eligible consumers whose private information was compromised in the targeted cyberattack.

The Byte Federal data breach settlement received preliminary court approval on April 20, 2025 and covers all living United States residents whose private information was affected in the data breach.

Byte settlement class members who file a timely, valid claim form can opt to receive two years of credit monitoring services, which include:
- Dark web scanning and immediate notification of potential unauthorized use of your data;
- Identity theft insurance with no deductible for up to $1,000,000;
- Real-time, one-bureau credit monitoring;
- Comprehensive public record monitoring; and
- Access to fraud resolution agents to help investigate and resolve instances of identity theft.
Per the official class action settlement website, class members may also submit a claim form for one of two types of cash payments. Consumers who choose Cash Payment A may claim up to four hours of time spent responding to the Byte Federal data breach, at a rate of $20 per hour. Those who choose Cash Payment B may submit proof of documented out-of-pocket losses caused by or related to the incident and be reimbursed up to $3,000 total for these losses, which can include:
- Legal, accounting and credit repair fees;
- Credit reporting fees or costs associated with freezing or unfreezing credit;
- Unreimbursed losses related to fraud or identity theft;
- Credit monitoring costs incurred when or after the data breach notice was mailed, up until the date the claim is submitted or postmarked; and/or
- Miscellaneous expenses such as fax, postage, notary, mileage, copying and long-distance telephone charges.
To file a claim form online, class members head to this page and log in with the unique ID and PIN provided in their original settlement notice.
Alternatively, a PDF of the claim form is available to print, fill out and mail back to the address listed on the second page of the document.
According to the settlement website, eligible class members may submit a claim form for each settlement benefit for which they qualify.
All claim forms must be submitted online or postmarked by August 19, 2015.
A hearing will be held on September 3, 2025 to determine whether the settlement will receive final court approval. Compensation will begin to be distributed to claimants only after final approval is granted and any appeals are resolved.
The Byte Federal data breach class action lawsuit alleged that Byte customers’ personal information—including dates of birth, names, Social Security numbers, addresses, government-issued ID documents, photographs, phone numbers and transaction information—was accessed by unauthorized third parties in a data breach that occurred on or around November 18, 2024.
