Philips Bryant Park, LLC is the defendant in a proposed class action filed by a blind individual in New York who claims the company failed to make its website accessible to the blind. The plaintiff claims he attempted to make a reservation at Bryant Park Hotel, but was unable to complete the transaction using the hotel’s website due to its various access barriers. According to the suit, “well-established guidelines” exist to provide blind people with equal access to websites, but Bryant Park Hotel did not implement this known technology. The complaint claims the website failed to make use of alternative text, accessible forms, adequate prompting and labeling, keyboard access, and banners that allow blind individuals to easily navigate through the site using screen readers. “The inaccessibility of Bryantparkhotel.com has deterred [the plaintiff] and Class members from the enjoyment of Bryant Park Hotel,” the suit says.
