Brevard Skin & Cancer Center has inked a class action settlement to resolve a lawsuit that alleged the Florida-based dermatology practice failed to adequately protect current and former patients’ private information from a September 2025 data breach.

The Brevard Skin & Cancer Center class action settlement received preliminary approval from the court on July 16, 2026. The settlement covers all living United States residents who were sent a notice by Brevard Skin & Cancer Center that their private information may have been impacted in the cyber incident.

Class members who submit a valid, timely claim form can receive up to $2,500 in reimbursement for out-of-pocket losses incurred between September 28, 2025 and November 16, 2026 due to the data breach. This benefit covers losses from fraud or identity theft and costs for credit reports, credit monitoring, freezing/unfreezing credit, replacing IDs and more.
Class members must submit proof, such as bank statements or receipts, to receive a documented-loss payment.
In lieu of a documented-loss payout, class members can submit a claim form for a $45 cash payment, with no proof required.
Lastly, all class members will automatically receive one year of CyEx Medical Shield Complete, which includes one-bureau medical data monitoring and identity theft insurance. CyEx enrollment codes have been sent to each class member by postcard.
To file a Brevard Skin & Cancer Center settlement claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.
All settlement claim forms must be submitted online or postmarked by November 16, 2026.
The court will determine whether to grant final approval to the Brevard Skin & Cancer Center data breach settlement following a hearing on November 30, 2026. Settlement benefits will begin to be made available after the deal has received final approval and any appeals are resolved.
The Brevard Skin & Cancer Center lawsuit alleged that the practice failed to adequately protect current and former patients’ sensitive data from a targeted cyberattack in September 2025. The suit claimed that the information compromised in the incident included names, dates of birth, billing and claims details, Social Security numbers, diagnosis and clinical information and more.
