Brazilian Wax, Inc. and its owner are the defendants in a proposed class action over alleged violations of the Fair Labor Standards Act (FLSA). The lawsuit claims the defendants, which own and operate 17 boutiques across Georgia and Tennessee, illegally misclassified workers as independent contractors. The lawsuit argues that a clear employer-employee relationship existed between the defendants and proposed class members, meaning almost every aspect of the workers’ days were controlled by Brazilian Wax. As a result of the alleged misclassification, the lawsuit claims, workers were not paid proper time-and-a-half overtime or minimum wages.
