A proposed collective action filed in Georgia alleges Atlanta Beverage Company (ABC) deprived workers of their rightful wages. The plaintiff, currently employed by ABC as a traveling merchandiser, says he and similarly situated employees regularly work more than 40 hours per week without being paid proper time-and-a-half overtime wages. As we’ve seen before in many unpaid wage lawsuits, at the heart of the case are allegations that proposed collective members—hourly workers—were misclassified as exempt salaried employees paid a flat-rate per week no matter how many hours they worked.
