A proposed class action out of New York claims the owning and operating entities of Allstate Painting failed to pay workers proper overtime and spread-of-hours wages. The plaintiff, who worked for the defendants as a painter, construction worker and driver, claims he regularly worked more than 40 hours per week without being paid time-and-a-half for all hours worked over 40. This extra work time, the plaintiff says, was spent performing required off-the-clock work after his shift had ended.
Additionally, the lawsuit says sometimes the plaintiff worked more than 10 hours per day without receiving spread-of-hours wages. Lastly, the defendants allegedly forced the plaintiff to sign a document that falsely stated the number of hours he worked in order to get paid each week.
