Two former employees of 7 Fold Technologies, LLC have filed a proposed class action against the company, claiming it failed to pay them minimum and overtime wages.
Two former employees of 7 Fold Technologies, LLC have filed a proposed class action against the company, claiming it failed to pay them minimum and overtime wages in accordance with the Fair Labor Standards Act (FLSA) and Arkansas state law. The plaintiffs say they worked for 7 Fold as installation technicians for DirecTV satellites, and that they regularly worked between 60 and 70 hours per week. According to the complaint, the installation techs were not paid time-and-a-half overtime wages for the hours they worked above 40 in a week because 7 Fold improperly classified them as exempt. Despite this classification, the defendant allegedly maintained control over most aspects of their work, including how they dressed, their schedules, which customers they were assigned to, their pay scale, the price of their services, and the number of jobs they were required to perform per day. The suit argues that the defendant’s control over the plaintiffs’ job duties qualifies them as employees rather than independent contractors, meaning they are entitled to overtime pay.
The complaint, which lodges four counts against the defendant, further alleges that the plaintiffs were required to use their own vehicles to drive to job sites. The plaintiffs claim that after the costs of vehicle operation and maintenance were deducted, their pay fell below the required minimum wage.
