According to the 14-page lawsuit, an unauthorized party gained access to East River Medical Imaging’s network between August 31 and September 20, 2023 and exfiltrated certain patient information. The data compromised in the incident reportedly includes patient names, dates of birth, addresses, phone numbers, Social Security numbers, and details on medications, medical procedures, imaging results and more.
The filing says that East River Medical Imaging waited until the day before Thanksgiving, November 22, to notify victims that their sensitive personal and medical data had been stolen.
The lawsuit blames the breach on “negligent acts and omissions” on the part of East River Medical Imaging, which allegedly failed to implement reasonable cybersecurity measures to ensure the sensitive data in its care was kept safe.
“Plaintiff and Class Members continue to be at significant risk of identity theft and various other forms of personal, social, and financial harm,” the suit stresses. “The risk will remain for their respective lifetimes.”
According to the complaint, East River Medical Imaging, prior to the incident, should have ensured that consumers’ sensitive data was stored securely, that data that was no longer needed was deleted, and that any unnecessary accessibility given to vendors was eliminated. The case argues that the defendant could have prevented the incident by ensuring proposed class members’ data was properly secured and encrypted, or, if unneeded, destroyed.
The lawsuit looks to represent all persons whose personally identifiable information was accessed and/or exfiltrated during the 2023 East River Medical Imaging data breach.
