$6.5M Omni Family Health Settlement Ends Class Action Over 2024 Data Breach

A class action lawsuit against Omni Family Health alleges that an unauthorized third party gained access to personally identifying information and private health information.

A $6.5 million class action settlement resolves a lawsuit filed against Omni Family Health over a 2024 data breach in which an unauthorized third party allegedly leaked personally identifying information (PII) and private health information (PHI) on the dark web.
The Omni Family Health class action settlement received preliminary approval from the court on September 5, 2025 and covers all United States residents whose personal information was potentially compromised in the data breach, which occurred on or about August 7, 2024.

Class members who submit a timely, valid claim and sufficient supporting documentation are eligible to receive up to $5,000 for unreimbursed personal losses incurred because of the Omni Family Health data breach. Per the settlement website, claimable monetary losses include:
- Unreimbursed losses relating to fraud or identity theft;
- Professional fees, including attorneys’ fees, accountant’s fees and fees for credit repair services;
- Costs associated with freezing or unfreezing credit with any credit reporting agency;
- Credit monitoring costs that were incurred on or after August 7, 2025; and
- Miscellaneous expenses, such as notary, fax, postage, copying, mileage and long-distance telephone charges.
Class members who submit a claim for out-of-pocket expenses must also include supporting documentation as evidence of their monetary losses, the settlement website specifies. This documentation does not include “self-prepared” documents, such as handwritten receipts.
Furthermore, per the settlement website, class members who submit a timely, valid claim form are eligible to receive a pro rata (equal share) cash payment from the net amount of the settlement fund. The amount of these payments—estimated to be roughly $105.56 per person, should around four percent of class members submit a valid claim—will be determined after all approved claims for out-of-pocket losses have been distributed and all other expenses have been paid by the settlement administrator.
The settlement website states that, additionally, all class members are eligible to receive two years of credit monitoring services from CyEx, including a $1,000,000 insurance policy with no deductible.
In recognition of the California Confidentiality of Information Act, class members who resided in California at any time between August 7, 2024 and January 5, 2026 are eligible for an additional $100 cash payment. The settlement administrator may reduce the payment if there are insufficient settlement funds to cover out-of-pocket losses and credit monitoring, the website notes.
To submit a claim form online, class members can visit this page of the Omni Family Health settlement website and log in with the unique ID and confirmation code found in their copy of the settlement notice. Class members who prefer to mail a paper copy can download the claim form here and mail it to the settlement administrator.
All Omni Family Health claim forms must be submitted online or postmarked by January 5, 2026.
A hearing is scheduled for February 26, 2026, to determine whether the settlement will receive the court’s final approval. Payments to class members will begin to be distributed only after final approval has been granted and any appeals have been resolved.
Additionally, Omni Family Health has agreed, as part of the class action settlement, to implement certain business practice changes designed to prevent future data breaches.
Omni Family Health is a nonprofit organization operating community health centers in California. The Omni Family Health class action lawsuit originated from a data breach on August 7, 2024, that impacted the personal information of current and former patients and employees. According to the lawsuit, Omni Family Health did not disclose that the data breach occurred and that PHI had been posted online until October 10, 2024.
