A $440K settlement ends a class action lawsuit against ProSmile Holdings over a July 2022 data breach.
A $440,000 settlement is set to resolve a proposed class action lawsuit over a July 2022 ProSmile Holdings data breach during which unauthorized third parties accessed consumers’ sensitive health, personal and financial information.

The ProSmile Holdings data breach settlement received preliminary approval from the court on May 14, 2025 and covers anyone in the U.S. whose private health information, personally identifiable information or financial information was potentially compromised during the data breach ProSmile experienced on or around July 7, 2022.

The class action settlement website states that ProSmile settlement class members who submit a timely, valid claim form can receive up to $5,000 in reimbursement for documented out-of-pocket losses, up to $500 in compensation for exposed Social Security numbers (SSNs), and/or an equal-share cash payment from the remainder of the $440,000 settlement fund after the payment of all other expenses, fees and compensations.
According to the settlement agreement, documented out-of-pocket losses “include, but are not limited to, unreimbursed costs, expenses, or charges incurred addressing or remedying identity theft, fraud, or misuse of personal information and/or other issues reasonably traceable to the Data Incident.” To submit a claim for compensation for these losses, class members must provide:
- Their name and current address;
- A brief description of the claimed expenses; and
- Documentation that supports the claimed losses.
It is also important to note that, per the settlement website, compensation for exposed SSNs and the pro-rata cash payment are mutually exclusive and cannot be claimed simultaneously. Settlement documents also state that the up to $500 in compensation for exposed SSNs may be reduced on a pro-rata basis depending on the total number of valid claims filed.
To submit a claim form online, class members can head to this page and log in with the notice ID and PIN provided in the settlement notice they received.
Alternatively, a PDF of the claim form is available to print, fill out and mail back to the address listed on page one of the form.
All claims must be submitted online or postmarked no later than September 25, 2025.
A hearing will be held on October 14, 2025 to determine whether the settlement will receive final approval from the court. Compensation will begin to be dispensed to eligible claimants only after final approval is granted and any appeals have been resolved.
The data breach class action lawsuit against ProSmile Holdings claimed that unauthorized third parties illegally accessed the sensitive personal, health and financial data of many ProSmile patients on or around July 7, 2022 due to the company’s failure to implement reasonable cybersecurity safeguards.
