$300K Medical Center Barbour Class Action Settlement Resolves Case Over October 2023 Data Breach

Medical Center Barbour has agreed to a $300K class action settlement over a 2023 data breach.
Medical Center Barbour (MCBH) has agreed to a $300,0000 class action settlement to wrap up litigation over an October 2023 data breach that allegedly exposed current and former patients’ and employees’ personally identifying and private health information to an unauthorized third party.

The MCBH class action settlement received preliminary approval from the court on October 3, 2025. The class action settlement covers approximately 61,014 individuals whose personally identifiable information (PII) and personal health information (PHI) were potentially compromised during the MCBH data breach, which occurred on or around October 29, 2023.

Per the settlement agreement, class members who submit a timely, valid claim form are eligible to receive up to $5,000 in reimbursement for out-of-pocket expenses incurred as a result of the MCBH data breach. Court documents state that the following expenses are eligible for reimbursement under the Medical Center Barbour settlement agreement:
- Unreimbursed costs to obtain credit reports;
- Unreimbursed fees relating to a credit freeze;
- Unreimbursed card replacement fees;
- Unreimbursed late fees;
- Unreimbursed over-limit fees;
- Unreimbursed interest and fees on payday loans taken out because of the data breach;
- Unreimbursed bank or credit card fees;
- Unreimbursed postage, mileage and other incidental expenses resulting from the data breach; and
- Unreimbursed costs associated with up to one year of credit monitoring or identity theft insurance purchased prior to the effective date of the settlement, with certification that it was purchased primarily because of the data breach.
In addition, all settlement class members who submit a valid claim form can also receive reimbursement for up to three hours of lost time spent dealing with the data breach, at a rate of $25 per hour, for a total of $75. This payment will count toward the $5,000 limit on out-of-pocket expenses, settlement documents state.
Each claim for out-of-pocket expense reimbursement must be submitted with personal attestation and supporting documentation, settlement documents state. The maximum amount of the personal-expense reimbursement will be increased or decreased on a pro rata (equal share) basis, depending on the total number of valid claims that are filed and the amount of money available in the settlement fund.
Class members may also submit a claim, with no proof required, for an alternative cash payment of $50. The amount of this cash payout will decrease pro rata for each class member depending on the number of claims filed and the amount of money remaining in the settlement fund, court documents relay.
Moreover, the MCBH data breach settlement will also provide two years of credit monitoring services to class members who submit a valid, timely claim form. After final approval, the settlement administrator will send each class member who made a credit monitoring claim an activation code for the service.
Settlement class members can submit a Medical Center Barbour claim form online by visiting this page on the settlement website and logging in with their unique ID and passcode, which can be found on the class action notice. Class members who prefer to submit a claim by mail can download the claim form here and mail it to the settlement administrator.
All claims must be submitted online or postmarked by January 2, 2026.
The final approval hearing for the MCBH class action settlement will be held on April 9, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
In addition to the above-listed benefits, MCBH says “it has taken and will continue to take measures to enhance the security of the environment impacted by the Data Incident,” according to the settlement agreement. These measures include supplementing cybersecurity monitoring with additional third-party service monitoring, using additional malware scanners, and expanding the entire monitoring program.
The MCBH class action lawsuit alleged that the Eufaula, Alabama, medical center “failed to implement and maintain basic security measures to adequately protect their Private Information,” which impacted the severity of the data breach.
