A $3,125,000 settlement ends a class action lawsuit against Midland States Bank and its subsidiaries over allegedly unfair overdraft and APSN fees.
A $3,125,000 settlement is set to resolve a class action lawsuit filed over allegedly unfair overdraft and APSN fees charged to Midland States Bank, Alpine Bank & Trust and/or Centrue Bank accountholders between April 8, 2012 and April 30, 2022.

The deal, which received preliminary approval from the court on March 30, 2025, covers the following groups of Illinois residents assessed the supposedly unfair bank fees by Midland States Bank and its subsidiaries:
- Consumers who had a personal checking account with Alpine Bank & Trust Co. between April 8, 2012 and February 28, 2018 and were assessed an overdraft (OD) fee on a debit card transaction despite having a sufficient available balance for the transaction and settled on negative funds for the transaction amount;
- Alpine Bank & Trust Co. accountholders who held a personal checking account between April 8, 2012 and February 28, 2018 and were assessed multiple insufficient funds fees, or one or more NSF fees followed by an OD fee related to a single check, ACH, wire transfer or other item;
- Consumers who had a personal checking account with Centrue Bank between April 8, 2012 and June 12, 2017 and were assessed an OD fee on a debit card transaction for which they had a sufficient balance for the transaction in their account and settled on negative funds for the transaction amount;
- Consumers who held a personal checking account with Midland States Bank between April 8, 2012 and April 30, 2022 and were issued an OD fee on a debit card transaction for which they had sufficient balance for the transaction in their account transaction and settled on negative funds for the transaction amount; and
- Individuals who held a personal checking account with Midland States Bank between April 8, 2012 and April 30, 2022 and were assessed an OD fee or NSF fee on a third-party merchant’s attempt to collect its own fee.
If you are a settlement class member, you should have received a notice informing you of the settlement. Class members covered by the Midland States Bank settlement can, upon the court’s final approval of the settlement, receive a pro rata portion of the $3,125,000 settlement based on the number of fees assessed to them during the relevant time periods mentioned above, the settlement website shares.
Should final approval be granted to the deal, no action will be required from an eligible class member to receive their portion of the settlement. Instead, class members will be directly issued their payment by account credit or check.
There will be a hearing on September 10, 2025 to determine whether the court will grant final approval to the settlement.
The class action lawsuit against Midland States Bank alleged that the bank and its subsidiaries assessed various unfair overdraft, APSN and NSF fees on their customers between 2012 and 2017, 2018 and 2022 respectively.
