24 Hour Fitness Sued After Removing Towel Service from Super Sport Fitness Clubs

A proposed class action has been filed over 24 Hour Fitness’ recent removal of towel service from the amenities offered to the gym chain’s higher-tier members.
A proposed class action lawsuit has been filed over 24 Hour Fitness USA, Inc.’s recent removal of towel service from the amenities offered to the gym chain’s higher-tier members. The plaintiff claims he paid for the defendant’s Super Sport membership based on representations that towel service would be provided and was robbed of the value of his membership when the service was uniformly discontinued in June 2019.
The 37-page lawsuit, which was removed to California’s Northern District in early December, explains that 24 Hour Fitness operates across the United States over 400 clubs at which it provides several levels of membership that range from “Active” to “Ultra Sport.” Once included in the more expensive “Super Sport” and “Ultra Sport” membership levels was towel service, which until recently, the suit says, allowed members at the fitness clubs to use the defendant’s towels. Towel service, the lawsuit goes on to allege, was especially attractive to prospective customers in that the defendant requires all members to use a towel during workouts.
The case claims that despite advertising towel service as part of the Super Sport membership package, 24 Hour Fitness in June 2019 made the decision to eliminate the service as a purported cost-saving measure and instead offer towels for sale at retail price. The plaintiff claims he relied on the defendant’s advertising when deciding to purchase his Super Sport membership and would have paid less had he known the included towel service would be eliminated.
According to the lawsuit, the defendant has refused to refund Super Sport members for the loss of the advertised amenity and in many instances has even raised membership fees.
The case looks to cover anyone who purchased the defendant’s Super Sport membership in California when one of the advertised amenities was towel service.
