A $2.8M+ Fathom Reality settlement offers cash to those who received at least one text despite their number's inclusion on the National Do Not Call Registry.
Fathom Realty has agreed to pay $2,847,456 as part of a class action settlement to resolve a lawsuit that alleged the company illegally sent marketing text messages via a former real estate agent to certain phone numbers listed in the National Do Not Call Registry.

The Fathom Realty settlement received preliminary court approval on October 29, 2025. The class action settlement covers anyone in the United States listed in the settlement class data who, within a 12-month period between August 15, 2021 and December 15, 2024, received more than one text message from or on behalf of former Fathom Realty real estate agent Marcus Edwards and whose number was registered in the National Do Not Call Registry for at least 30 days at the time the messages were received.

To submit a claim form online, class members should head to this page of the settlement website and enter the unique ID and PIN found on their copy of the settlement notice. Alternatively, class members who prefer to submit a claim form by mail can download it here to print, fill out and return to the settlement administrator.
Per settlement documents, Fathom Realty class members who submit a valid, timely claim form are eligible to receive up to $48 per text message received from Fathom Realty between August 15, 2021 and December 15, 2024. Payouts from the class action settlement may be decreased on a pro rata (equal share) basis should the number of valid claims exceed the amount of money in the settlement fund, court documents state.
All Fathom Realty claim forms must be submitted online or postmarked by January 7, 2026.
The final approval hearing for the Fathom Reality class action settlement is scheduled for February 6, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Fathom Reality class action lawsuit arose after the plaintiff allegedly received several promotional messages from Fathom Reality on behalf of agent Marcus Edwards, despite their phone number’s inclusion on the National Do Not Call Registry. The plaintiff alleged these promotional texts were a direct violation of the federal Telephone Consumer Protection Act (TCPA), which prohibits telephone solicitations to individuals who have listed their phone numbers on the National Do Not Call Registry.
