$2.3M Sysco Settlement Ends Class Action Lawsuit Over May 2023 Data Breach

A $2.3M settlement resolves litigation against Sysco Corporation over a May 2023 data breach.
A $2.3 million settlement is set to resolve a class action lawsuit against Sysco Corporation over a May 2023 cybersecurity incident that leaked the personally identifiable information of thousands of people.

The Sysco Corporation class action settlement received preliminary court approval on May 9, 2025 and covers all United States residents who received a notice of the Sysco cybersecurity event in or around May 2023.

Settlement class members who submit a timely, valid claim form may receive reimbursement for documented out-of-pocket losses, credit monitoring services and residual cash payments.
Class members may submit a claim for up to $5,000 in documented out-of-pocket losses, which include:
- Costs related to accessing, freezing or unfreezing credit reports with any agency;
- Credit monitoring or other mitigative costs;
- Notary, postage, long-distance telephone, copying, fax and mileage costs; and
- Unreimbursed losses, costs or expenditures resulting from falsified tax returns, identity theft/fraud or other misuse of leaked personal information.
Class members who submit a claim for out-of-pocket loss reimbursement must submit documented proof of the losses, accompanied by their current name and address and a brief description of the nature of the loss or losses, the settlement website specifies.
It is important to note that the maximum amount available for out-of-pocket loss reimbursement may be reduced on a pro-rata—or equal share—basis.
Class members who submit a timely, valid claim form may also receive a cash payout of up to $599 in addition to out-of-pocket loss reimbursement, the Sysco settlement website states. Cash payments from the Sysco settlement are estimated to be between $100 and $200 per person, the settlement website states.
Sysco settlement class members may also claim two years of three-bureau identity theft protection and credit monitoring services, which include:
- Identity theft insurance;
- Dark web scanning that will notify the user if unauthorized use of their personal information is detected;
- Access to fraud resolution agents; and
- Real-time credit monitoring with Experian, Equifax and TransUnion.
To submit a Sysco claim form online, head to this page and log in with the unique Class Member ID found in your settlement notice.
Alternatively, class members may download a PDF of the claim form to print, fill out and mail to the address listed on the first page of the form.
All Sysco Corporation settlement claim forms must be submitted online or postmarked no later than September 8, 2025.
A hearing will be held on October 9, 2025 to determine whether the settlement will receive final approval from the court. Compensation from the Sysco class action settlement will begin to be dispensed to class members only if final approval is granted and after any appeals are resolved.
The data breach class action lawsuit against Sysco Corporation alleged that more than 71,000 consumers’ personal information—including Social Security numbers, names, account numbers, email addresses and phone numbers—was accessed by an unauthorized third party during a cyberattack in May 2023 due to the food product distributor’s lack of adequate cybersecurity.
