$2.102M DoorDash Settlement Ends AG Lawsuit Over Misclassified California Delivery Drivers

A $2.102M DoorDash AG settlement offers cash to California delivery drivers who opted out of prior lawsuits.
DoorDash has been ordered to pay a $2,102,000 settlement to resolve a lawsuit brought by the San Francisco District Attorney that alleged the food-delivery service misclassified drivers as independent contractors, not employees, which effectively stripped them of certain protections, benefits and pay.

The DoorDash final stipulated order was signed by a California Superior Court judge on September 11, 2025 and covers California DoorDash delivery drivers who have not individually settled their claims with the company and meet the following criteria:
- Drivers who completed at least one delivery in California between August 30, 2016 and December 31, 2020 AND opted out of the settlement class in Marko, et al. v. DoorDash Inc. (Case No. BC659841); and
- Drivers who completed at least one delivery in California between June 17, 2016 and August 29, 2016 AND opted out of the settlement class in Marciano, et al. v. DoorDash, Inc. (Case No. CGC-15-548101)
According to the order, approximately 773 California DoorDash drivers opted out of the Marko class settlement without resolving their claims, and approximately 11 drivers opted out of the Marciano class without settling their claims. Together, the order says, these drivers comprise the group of “Restitution Eligible Drivers” covered by the DoorDash settlement.

According to the website, DoorDash settlement class members who submit a valid, timely claim form are eligible to receive a one-time cash payment. The final amount of this payment, the order notes, will be determined by the total number of valid claims filed and how much remains in the net settlement fund after the payment of attorneys’ fees, settlement administration costs and other litigation expenses.
To submit a DoorDash claim form online, class members can head to this page and enter the class member ID and PIN provided on their copy of the settlement notice. Alternatively, class members can download a PDF of the claim form from the settlement website to print, fill out and return by mail to the address of the settlement administrator listed on the document.
Consumers who believe they may be a DoorDash settlement class member but did not receive a notice may contact the settlement administrator to confirm their identity and obtain further instructions.
All DoorDash AG settlement claim forms must be submitted online or by mail by March 18, 2026.
The court has ordered that there be a continued compliance hearing on April 30, 2026, during which the settlement administrator will report the number of claims made and a summary of distributions.
The DoorDash AG lawsuit alleged that the food-delivery service misclassified the employment status of its drivers in violation of the California Business and Professions Code.
