Portico Decking Problems Prompt Filing of Class Action Suit
Last Updated on June 27, 2017
Widespread allegations of considerable defects in Portico decking have led to a classaction lawsuit against the manufacturer, Fiberon, LLC. Customers allege that problems with the deck cause it to develop extensive dark spots throughout the surface, but that Fiberon uniformly rejects claims under its 20 year warranty. A classaction lawsuit has been filed against Fiberon, LLC for monetary damages, declaratory and equitable relief, and restitution and/or disgorgement of profit.
The Portico decking is reportedly victim of a defect that causes extensive mold, mildew and/or other fungal growth.
Portico decking is a composite decking material comprised of wood fiber and polyethylene and is purportedly manufactured to last for longer than traditional wood decking. It was advertised by Fiberon as an alternative to "Traditional wood decking [that] fades, molds, cracks, splinters, and needs to be treated and sealed regularly for the deck to maintain its original look and feel." Fiberon backs its product with a 20 year warranty that guarantees that “the Decking & Railing will not check, splinter, peel, rot, or suffer structural damage from fungal decay.”
Instead, the Portico decking is reportedly victim of a defect that causes extensive mold, mildew and/or other fungal growth that manifests itself as a uniform spotty discoloring across the entire deck. This allegedly occurs even with proper installation, maintenance, and cleaning. In addition, reports of problems with the deck have been met with recommendations by Fiberon to clean the decking material with specific chemical products. Customers claim that not only does this method not remedy the situation, but that in some cases it has actually made the problem worse.
Fiberon, LLC is also known as Fiber Composites, LLC. In response to customer complaints and class action suits settled by some competitors, Fiberon removed Portico decking products from the market. If you or someone you know has Portico decking that suffers from these unsightly and unexpected problems, you may be eligible to receive compensation for replacement of the product plus any other damages.
